Recent events pertaining to Regal Treasury Private Bank Limited ("RTPB") have evidently led to unusually large-scale withdrawals, by depositors, of their deposits held with RTPB. The concomitant outflow of funds has apparently resulted in RTPB experiencing difficulties in maintaining its required levels of liquidity. Based, however, upon the information with regard to RTPB rendered in terms of the provisions of the Banks Act, 1990 (Act No. 94 of 1990 - "the Act"), this Office has no reason to believe that RTPB is not solvent. Consequently, the Minister of Finance has deemed it desirable, in the public interest, with the written consent of the Chairperson of the Board of RTPB, in terms of section 69 of the Act, with effect from 26 June 2001, to appoint a curator to RTPB. The head office of RTPB is situated at Stone Manor, 318 Rivonia Boulevard, Rivonia, South Africa, 2128. An important reason for the appointment of the curator to RTPB is to facilitate the orderly management of the bank, including the management of the bank’s liquidity having regard to the bank's liquidity situation. Upon the appointment of the curator, the management of RTPB vests in the curator, subject to the supervision of the Registrar of Banks and any other person vested with the management of the affairs of RTPB is divested thereof. The curator also is required to recover and take possession of all of the assets of RTPB.
